SCHEDULING ORDER: 1. The Court reminds the parties that, under Rule 1, they share with the Court the duty to construe, administer, and employ the Federal Rules of Civil Procedure to secure the just, speedy, and inexpensive determination of this action. 2. The Court refers this case to the appropriate United States Magistrate Judge (Magistrate Judge Matthew A. Stinnett) for this Division. 3. Discovery disputes shall be resolved in the manner set forth within this Order. 4. Parties shall exchange Rule 26(a)(1) disclosures by 7/20/2019. Supplementation is due within 30 days. 5. Parties shall file any motions to join parties or amend pleadings by 8/1/2019. 6. NLT 1/15/2020, parties shall complete all pretrial fact and expert discovery. 7. NLT 11/15/2019, parties shall disclose expert witnesses. NLT 1/1/2020, parties shall provide rebuttal expert, if any. 8. NLT 2/1/2020, parties shall file all dispositive motions and Dambert motions. 9. NLT 4/6/2020, Pretrial filings due. 10. NLT 4/13/2020, counsel shall file any motions in limine and detailed objections. 11. FINAL PRETRIAL CONFERENCE set for 4/28/2020 at 01:30 PM in LEXINGTON before Judge Robert E. Wier. 12. At the pretrial conference, counsel shall prepare in the manner set forth in this Order. 13. NLT 7 working days prior to trial, counsel shall submit to the Court's Chambers a copy of each documentary exhibit. 14. JURY TRIAL set for 5/11/2020 at 09:00 AM in LEXINGTON before Judge Robert E. Wier. Counsel shall be in court at 8:30 a.m. (4 Days). 15. The Court builds the case schedule based on party input. Modification of this schedule thus is disfavored and will occur only under the standards and mechanics of Rule 16 and/or Rule 6, as applicable.
