ORDER: 1. Clerk of the Court shall docket Bartleson's correspondence #9 as a notice of appeal and transmit to USCA for the Sixth Circuit; 2. Clerk shall send Bartleson a Sixth Circuit Form 4 and a Certificate of Inmate Account [EDKY Form 523] 3. Bartleson must pay $505.00 appellate filing fee to Clerk of Court or: (1) complete Sixth Circuit Form 4; (2) have prison staff complete and sign the Certificate of Inmate Account; and (3) file both documents with THIS Court; 4. USCA for the Sixth Circuit will dismiss the appeal for failure to prosecute if Bartleson does not take these steps within 28 days; 5. The Clerk of the Court shall send a copy of this Order to the Clerk of the Court of Appeals for the Sixth Circuit.. ORDER: 1. The Clerk shall modify the docket to identify the plaintiff as Karl W. Bartleson, Jr., with Carl W. Bartleson, Jr. as an alternative designation. 2. Bartelson's #3 MOTION for Leave to Proceed in forma pauperis is GRANTED. 3. Because Bartleson has been granted pauper status in this proceeding, the $50.00 administrative fee is waived. 4. The Clerk shall open an account in Bartleson's name for receipt of the filing fee. The Clerk shall complete a Notice of Payment Form (Form EDKY 525) and shall send the Notice and a copy of this Order to the warden of the institution in which Bartleson is confined. 5. Within 28 days, Bartleson's custodian shall deduct $53.92 from Bartlesons inmate account and remit that sum to the Clerk of the Court as an initial partial filing fee. 6. For each month thereafter, if the amount in Bartlesons inmate account exceeds $10.00, his custodian shall deduct from Bartlesons inmate account an amount equal to 20% of his income for the preceding month and remit that sum to the Clerk of the Court. The custodian shall continue such monthly payments until the entire $350.00 filing fee is paid. 7. This matter stands submitted for initial screening.
