ORDER: The Court GRANTS #4 MOTION for warning order attorney by USA, and ORDERS as follows: 1)The Court hereby NOTIFIES the Unknown Spouse of Walter Wayne Lucas that the USA has initiated an action naming her as Dft in Federal Court. The Court further WARNS the notified party that a failure to appear and defend in this action w/in 51 days could result in entry of a default j/ment in the Pla's favor. 2)The Court APPOINTS the practicing Atty Jeffrey C. Rager as WOA for the Unknown Spouse of Walter Wayne Lucas. 3) The WOA Shall: a)Make diligent effort to inform the Dft, by mail, concerning the pendency/nature of this mortgage foreclosure action; b)Report the results of his efforts to the Court w/in 60 days from the date of entry of this Order. c)If the WOA is unable to notify the Dft re this action's pendency, he shall so report, and, if able to present a defense, shall then file an answer on Deft's behalf; d)Provide a copy of the report to COR for the USA. 4)The Court authorizes the WOA, in connection w/ efforts to notify the Dft, to incur reasonable expenses. 5) Upon receipt of this Order, Pla's counsel shall cause to be delivered, by mail or by electronic means, to the WOA's office the following: a copy of the complaint, a copy of the Pla's motion for this Order, and a copy of this Order. 6)Upon report filing, the WOA may also file a motion and affidavit for payment of the WOA's fee and expenses. 7)The WOA may notify the Court if the payment is not received w/in 60 days of any Order awarding fees and expenses.
