November 15, 2019 Opinion or Order Filing 8 SCHEDULING ORDER: (1) Parties' #7 proposed agreed order to bifurcate is GRANTED. (2) The following schedule is adopted for disposition the plaintiff's contractual claims: (3) NLT 11/25/2020, parties shall exchange Rule 26(a)(1) information. (4) NLT 3/2/2020, plaintiff shall disclose expert witness. NLT 4/6/2020, defendants shall disclose expert witness. (5) Supplementation under Rule 26(e) shall be due within 30 days of the discovery, but NLT 30 prior to the close of discovery. (6) NLT 6/1/2020, parties shall complete all discovery. (7) All discovery disputes are referred to the United States Magistrate selected by random draw (Magistrate Judge Matthew A. Stinnett). (8) All motions for extensions of time shall be referred to the undersigned fordisposition. The parties are advised in advance that such motions are not favored and must be accompanied by a memorandum and affidavit of counsel outlining sufficient grounds for granting the relief sought. (9) Parties may not, by agreement, extend any of the deadlines set forth in this Scheduling Order. (10) Plaintiffs have until 1/31/2020, to file any motions to amend and /or join additional parties. Defendants have until 2/14/2020. (11) NLT 7/1/2020, dispositive and daubert motions due. (12) Pretrial filings due on or before 10/26/2020. (13) On or before 10/26/2020, counsel shall pre-mark and number all exhibits. (14) On or before 10/26/2020, counsel shall file and submit Agreed Proposed Jury Instructions. (15) On or before 11/2/2020, any objections due. (16) Pretrial filings may be submitted to the undersigned at reeves_chambers@kyed.uscourts.gov. (17) NLT 11/9/2020, parties shall submit a copy of each exhibit to the Court's chambers. (18) JURY TRIAL set for 11/16/2020 at 09:00 AM in LEXINGTON before Judge Danny C. Reeves. Counsel to be present at 8:30 a.m. (3 days). (19) The parties are directed to file a joint status report the first Monday of each month. Failure to timely comply with this requirement shall result in the matter being set fora status conference, requiring the attendance of counsel and the parties.
