SCHEDULING ORDER: 1. Within 10 days, parties to exchange Rule 26(a)(1) as required; 2. NLT 4/10/2020, plaintiff disclose expert witnesses; NLT 5/8/2020, defendants disclose same; 3. Plaintiffs may take a maximum of 15 depositions, Defendants may take a combined maximum of 15 depositions; 6. Discovery disputes referred to U.S. Magistrate Judge selected by random draw (Stinnett); 7. Motions for extension shall be referred to the undersigned for disposition; 8. Parties may not by agreement extend any deadlines set forth in this scheduling order or for responding to motions; 9. NLT 2/28/2020, plaintiff file motions to amend pleadings or join additional parties; NLT 3/31/2020, defendants file same; 10. Dispositive Motions due by 8/10/2020; 11. The Court declines to schedule a PTC at this time; 12. By 12/23/2020 counsel shall file, submit to Chambers & provide to opposing counsel: witness lists, exhibit lists, pretrial memorandum; 13. By 12/30/2020, counsel shall pre-mark & number all exhibits & provide to opposing counsel; 14 By 12/30/2019, counsel shall file with Clerk & submit to Chambers Agreed Proposed Jury Instructions, 15. Objections due by 12/30/2020; 16. Pretrial Filings may be submitted via email to Chambers; 17. NLT 1/8/2021 parties submit to chambers a copy of each exhibit; 18. JURY TRIAL set for 1/19/2021 at 09:00 AM in LEXINGTON before Judge Danny C. Reeves, counsel present at 8:30 a.m. (3 days); 19. Parties are directed to file a joint status report the first Monday of each month; 20. Parties are directed to use the services of a private mediator in the even they seek to mediate; 21. ORDER FOR MEETING AND REPORT: 1) W/in 30 days, parties shall conduct meeting to discuss the possibilities for a settlement or resolution of the case. 2) At the time of the meeting, counsel shall exchange disclosures required by Rule 26(a)(1). 3) NLT 10 days after the meeting, counsel shall file a joint report outlining the proposed discovery plan. Parties should contemplate a trial date w/in 12 months or less. The report shall include: (a) parties' views and proposals; (b) length of time necessary to join other parties and to amend the pleadings; (c) length of time necessary to file motions; (d) length of time necessary to complete all pretrial discovery, including expert witness discovery; (e) length of time necessary to make expert disclosures; (f) Probable length of trial; (g) dates mutually convenient for trial; (h) whether the parties desire a scheduling conference before entry of a scheduling order; and (i) decision as to whether the action may be referred to a US Magistrate Judge.
