The Defendants Motion to Dismiss 3 Plaintiffs statutory claim arising under KRS § 337.060 is GRANTED. 3. The Defendants Motion to Dismiss 3 Plaintiffs tort claims, including claims of fraud and negligent misrepresentation, is DENIED. 4. Plaintiffs Motion for Leave to File an Amended Complaint 7 to plead with more particularity his negligence and promissory estoppel claims is DENIED.
