MEMORANDUM OPINION & ORDER: 1. The defendants motion for summary judgment 72 with respect to Barretts 42 U.S.C. § 1983 claim is GRANTED; 2. The plaintiffs 42 U.S.C. § 1983 claim is DISMISSED WITH PREJUDICE; 3. The plaintiffs motion 75 for partial summary judgment is DENIED; 4. The plaintiffs state law claim of outrage is DISMISSED WITHOUT PREJUDICE; 5. The pre-trial conference and jury trial in this matter are CANCELLED; 6.
