Filing 7 MEMORANDUM OPINION AND ORDER: Jerry Dean Robinson, a pretrial detainee being held at the Bell County Detention Center, has filed a pro se civil rights complaint. [Record No. #1 ] The Court previously granted Robinson's motion to pay the filing fee in installments. [Record No. #6 ] The complaint is pending for initial screening. Following screening, the Court Will dismiss a complaint that is frivolous or malicious, fails to state a claim upon which relief may be granted, or seeks monetary relief against an immune defendant. Accordingly, it is hereby ORDERED that Robinson's complaint [Record No. #1 ] is DISMISSED and this action is DISMISSED and STRICKEN from the Court's docket. Signed by Judge Danny C. Filing 6 ORDER: GRANTING #2 Motion for Leave to Proceed in forma pauperis: The Court has reviewed Robinson's financial information and will allow him to proceed as a pauper on the terms established by 28 U.S.C. 1915(b). Because Robinson has been granted pauper status, the $50.00 administrative fee will be waived. Accordingly, it is hereby ORDERED as follows: 1. Robinson's motion to proceed in forma pauperis [Record No. #2 ] is GRANTED. Robinson is required to pay the $350.00 filing fee for this civil action as set forth below. 2. The financial documentation provided by Robinson indicates that he lacks sufficient assets to pay an initial partial filing fee. Therefore, payment of such fee is DEFERRED. 3. The Clerk of the Court shall open an account in Robinson's name for receipt of the filing fee. The Clerk shall complete a Notice of Payment Form [Form EDKY 525] containing: (1) Robinson's name; (2) Robinson's inmate registration number; and (3) this case number. The Clerk shall serve a copy of this Order and the Notice of Payment Form upon the warden of the institution where Robinson is currently confined. 4. Each month, Robinson's custodian shall send the Clerk of the Court a payment in an amount equal to twenty percent (20%) of Robinson's income for the preceding month out of his inmate trust fund account, but only if the amount in the account exceeds $10.00. The custodian shall continue such monthly payments until the entire $350.00 filing fee is paid. 5. Robinson must immediately advise the Clerk's Office of any change to his current mailing address. Failure to do so may result in dismissal of this case. 6. This matter stands submitted for initial screening. Signed by Judge Danny C. Reeves on 10/16/2019.
