March 29, 2021 Opinion or Order Filing 8 SCHEDULING ORDER: 1. The parties shall exchange initial Rule 26(a)(1) disclosures by April 7, 2021. 2. Plaintiff shall have up to and including November 30, 2021, in which to amend pleadings or to join parties. Defendant shall have up to and including January 4, 2022, in which to amend pleadings or to join parties. 3. Per Rule 26(a)(2), no later than November 14, 2021, Plaintiff shall disclose the identity of expert witnesses who may be used at trial, accompanied by written reports signed by the Rule 26(a)(2)(B) expert witnesses and/or written summaries consistent with Rule 26(a)(2)(C), as applicable, all in compliance with the rule. These disclosures need not be filed in the Court record. No later than December 21, 2021, Defendant shall provide same. Supplementation under Rule 26(e), if any, shall be made by January 31, 2022. 4. All non-expert written discovery shall be completed on or before October 16, 2021. The parties shall complete all expert discovery by January 31, 2022. 5. No later than March 1, 2022, counsel for the parties shall file all dispositive motions, with responses thereto in accordance with the local rules. 6. In accordance with District Judge Wiers referral order (D.E. 3), the Court declines at this time to schedule a pretrial conference, trial, or deadlines for related filings. 7. The Court builds the case schedule based on party input. Modification of this schedule thus is disfavored and will only occur under the standards and mechanics of Rule 16 and/or Rule 6, as applicable. 8. At the outset, the Court reminds the parties that, under Rule 1, they share with the Court the duty to construe, administer, and employ the Federal Rules of Civil Procedure to secure the just, speedy, and inexpensive determination of this action; 2.
