July 9, 2021 Opinion or Order Filing 9 SCHEDULING ORDER: 1. The parties shall exchange initial Rule 26(a)(1) disclosures by 8/10/2021. The parties shall serve answers to written discovery requests by 9/1/2021. 2. The parties shall have up to and including 1/15/2022, in which to amend pleadings or to join parties. The parties also have until 1/15/2022, in which to exchange preliminary witness lists. 3. Per Rule 26(a)(2), no later than 4/30/2022, Plaintiff shall disclose the identity of expert witnesses who may be used at trial, accompanied by written reports; No later than 6/30/2022, Defendant shall provide same. Supplementation under Rule 26(e), if any, shall be made by 7/30/2022. 4. All written fact shall be completed on or before 2/28/2022. The parties shall complete all expert discovery and evidentiary depositions by 8/30/2022. These deadlines mean, as relevant, service of written discovery calculated to secure a response by and compliant with the deadline. 5. No later than 10/30/2022, counsel for the parties shall file all dispositive motions, with responses thereto in accordance with the local rules. 6. In accordance with District Judge Wier's referral order (D.E. 5), the Court declines at this time to schedule a pretrial conference, trial, or deadlines for related filings. 7. The Court builds the case schedule based on party input. Modification of this schedule thus is disfavored and will only occur under the standards and mechanics of Rule 16 and/or Rule 6, as applicable. 8. At the outset, the Court reminds the parties that, under Rule 1, they share with the Court the duty to construe, administer, and employ the Federal Rules of Civil Procedure to secure the just, speedy, and inexpensive determination of this action; 2.
