July 26, 2021 Opinion or Order Filing 10 SCHEDULING ORDER: Pursuant to Fed. R. Civ. P. 16, and upon consideration of the parties' Rule 26(f) report, the Court adopts the following schedule for discovery and dispositive motions in this case: 1. No later than 10 days from the date of this Order, the parties shall exchange any information required by Rule 26(a)(1) which has not previously been exchanged. 2. The parties shall complete limited discovery on the coverage issue by October 25, 2021. 3. Defendant's dispositive brief on the coverage issue1 shall be filed by November 12, 2021. Plaintiffs' response brief shall be filed by December 10, 2021. Defendant's reply brief shall be filed by December 30, 2021. 4. Motion practice shall be governed by Local Rule 7.1 except as otherwise provided in this order. Failure to respond to a motion shall be grounds for the Court to conclude that any arguments in opposition thereto have been waived. 5. As the parties agree that the Court disposition of the coverage issue may affect whether or not the case proceeds further, no pretrial schedule or trial date is necessary. 6. The Court HEREBY ORDERS that a TELEPHONIC STATUS CONFERENCE set for 9/10/2021 at 11:30 AM in LONDON before Magistrate Judge Hanly A. Ingram. The call will be off the record and for counsel only.
