ORDER re #5 Motion for Leave to Proceed in forma pauperis: 1. Rivera-Ruperto's motion to proceed in forma pauperis [Record No. 5] is GRANTED. 2. Within twenty-eight (28) days, Rivera-Ruperto must pay $58.53 to the Clerk as an initial partial filing fee. The Clerk is directed to open an account in Rivera-Ruperto's name for receipt of the filing fee. The Clerk is further directed to complete a Notice of Payment Form (Form EDKY 525) with (a) Rivera-Ruperto's name, (b) his inmate registration number, and (c) this case number. The Clerk is directed serve a copy of this Order and the Notice of Payment Form upon the Jailer/Warden of the institution in which Rivera-Ruperto is currently confined. 3. Each month Rivera-Ruperto's custodian is directed to send the Clerk of the Court a payment in an amount equal to 20% of his income for the preceding month out of his inmate trust fund account, but only if the amount in the account exceeds $10.00. 4. Rivera-Ruperto is directed to immediately advise the Clerk's Office of any change in his current mailing address. Failure to do so may result in dismissal of this case. 5.
