December 15, 2022 Opinion or Order Filing 4 ORDER: (1) Broussard's current habeas petition (Doc. #1 ) is DENIED without prejudice, and this specific civil action is STRICKEN from the Court's docket; (2) That said, the Clerk's Office shall send Broussard the following blank forms: a. Petition for a Writ of Habeas Corpus Under 28 U.S.C. 2241 [E.D. Ky. 521 Form]; b. Application to Proceed in District Court Without Prepaying Fees or Costs [AO 240 Form]; and c. Certificate of Inmate Account Form [E.D. Ky. 523 Form]; and (3) Broussard may file a new civil action regarding this matter. To do so, Broussard must fully complete, sign, and file the E.D. Ky. 521 Form. At the same time, Broussard must also complete and file both the AO 240 and E.D. Ky. 523 Forms in order to pursue pauper status, or, alternatively, he must either pay the $5.00 filing fee or at least submit a copy of a completed BP-199 Form that he filed with prison officials requesting that the institution withdraw funds from his inmate account to pay the filing fee in this case.
