February 8, 2023 Opinion or Order Filing 9 ORDER: Court ADOPTS following schedule for discovery and dispositive motions: 1. Parties shall exchange initial Rule 26(a)(1) disclosures by APRIL 10, 2023. Parties shall exchange supplemental information required by Rule 26(e). Supplementation due within 30 days of discovery of new information or the need to supplement. 2. Parties have up to and including NOVEMBER 15, 2023 to amend pleadings or join parties. 3. all fact and exert discovery shall be completed on or before FEBRUARY 28, 2024. 4. Per Rule 26(a)(2), NLT DECEMBER 1, 2023, Plaintiff shall disclose identity of expert witness, in compliance with Rule 26(a)(2)(B) and Rule 26(a)(2)(C). NLT JANUARY 15, 2024, Defendants shall provide same. 5. NLT MAY 1, 2024, counsel shall file all dispositive motions, with responses governed by local rule. Any depositions cited in motion or brief must be filed in entirety with motion or brief. 6. Court HEREBY ORDERS a mid-discovery telephonic status conference SHALL occur on FRIDAY, AUGUST 25, 2023, AT 11:30 A.M. The call, based in London, will be off the record and for counsel only. To join the teleconference, the parties are DIRECTED to dial (606) 371-5577 and enter the phone conference ID 255 826 674#. 7. Per referral order (D.E. #3 ), Court declines at this time to schedule a pretrial conference, trial, or deadlines for related filings. Upon resolution of summary judgment motions or expiration of deadlines for same, Judge Wier will set other deadlines and schedule further proceedings. Should parties seek to establish Daubert or in limine deadlines contemporaneous with dispositive motion deadlines set forth above, they may file a motion to amend this Scheduling Order describing need for such deadlines. 8. Court builds case schedule on party input. Modification is disfavored and will only occur under Rule 16 and/or Rule 6. 9.Other than the agreed-upon discovery limits within the parties Rule 26(f)report, the default limits within the discovery rules apply.
