ORDER: 1. The Court DENIES DE #3 , Stevens's motion to proceed in forma pauperis, without prejudice; 2. The Court ORDERS the Clerk of the Court to mark the assigned case number on (1) Affidavit of Assets/In Forma Pauperis Application [Form AO-240] and (2) a Certificate of Inmate Account [EDKY Form 523]; 3. The Court ORDERS Stevens, should he wish to proceed with the lawsuit, to pay the $402.00 filing and administrative fees or (1) have the Certificate of Inmate Account certified by prison staff, (2) complete the complete the Affidavit of Assets/In Forma Pauperis Application, and (3) file both of them with the Court. These steps must be taken within 30 days of this Order (by May 29, 2023), or the case will be dismissed, without prejudice, for failure to prosecute. Signed by Judge Robert E. Wier on 4/28/2023.
