ORDER: 1. Ellis's motion for leave to proceed in forma pauperis [R. #3 ] is GRANTED. As a result, the administrative and filing fees for this matter are WAIVED; 2. Pursuant to Younger v. Harris, 401 U.S. 37 (1971), the Court ABSTAINS from further evaluating or adjudicating Ellis's excessive force claims at this time; 3. This matter is STAYED for the pendency of Ellis's state court criminal proceedings; and 4. Every ninety (90) days, Ellis must provide the Court with a report explaining the status of his state criminal case and whether any charges remain pending or have been resolved, and if they have been resolved, how. Failure to provide the Court with these status reports may result in Elliss civil rights claims being dismissed for failure to prosecute. Signed by Judge Gregory F.
