MEMORANDUM OPINION & ORDER: Upon receiving additional briefing, Court will rule on Columbia's partial motion for summary judgment. For reasons stated, it is accordingly ORDERED that: (1) Raven and Silver Slate SHALL RESPOND to Colu mbia's supplemental brief, R. 266 , no later than Monday, June 30, 2014. Whatever Columbia covered in that brief, however, dfts must analyze which issues have been "actually decided," applying the inferential approach laid out by Court in this opinion. See supra Part II.B. And then, assuming all issues Columbia says have been decided actually were, dfts must also analyze whether those issues satisfy any elements of Columbia's causes of action, warranting full or partial summary judgment on any claims.
