August 12, 2019 Opinion or Order Filing 6 SCHEDULING ORDER: 1. Court reminds the parties that, under Rule 1, they share with the Court the duty to construe, administer, and employ the FRCP to secure the just, speedy, and inexpensive determination of this action. 2. Per 28 U.S.C. 636(b) and FRCP. 72, Court refers this case to the appropriate US Magistrate Judge for this Division and docket for purposes of: See a - e. 3. Discovery disputes shall be resolved in the following manner:See a - e. 4. Ptys shall exchange Rule 26(a)(1) disclosures by September 8, 2019. Supplementation due w/in 30 days of discovery of new info but NLT 30 days prior to discovery ddl. 5. Ptys shall file any motion to join parties or amend pleadings by October 15, 2019. 6. No later than February 14, 2020, counsel for the parties shall complete all PT discovery. 7. Per Rule 26(a)(2), NLT October 15, 2019, Plaf shall disclose the identity of expert witnesses who may be used at trial, accompanied by written reports signed by the Rule 26(a)(2)(B) expert witnesses and/or written summaries consistent with Rule 26(a)(2)(C), These disclosures need not be filed in the Court record. No later than November 15, 2019, Dft shall provide same. 8. NLT March 15, 2020, counsel for the parties shall file all dispositive motions and Daubert motions. Response & Reply time governed by local rule. 9. NLT May 6, 2020, counsel shall file with the Clerk and provide to opposing counsel a copy of the following, each to be filed as a separate document: See a - d. 10. NLT May 20, 2020, counsel shall file with the Clerk & provide to opposing counsel a copy of any motions in limine and detailed objections. Each party shall fully respond to motions in limine and objections by NLT May 27, 2020. 11. This action is assigned for a pretrial conference on June 3, 2020, at 11:00 a.m. at the US Courthouse in Pikeville. The attorneys who will be trying this action shall be present at the PTC along with all parties. 12. At the PTC, counsel for the parties shall be prepared to: See a - e. 13. No later than seven working days prior to the trial of this action, counsel shall submit to the Courts Chambers a copy of each documentary exhibit. 14. This action is assigned for trial by jury on June 17, 2020, at 9:00 a.m. at the US Courthouse in Pikeville. Counsel shall be in court at 8:30 a.m. The anticipated length of trial is three days. 15. Court builds case schedule based on party input. Modification of this schedule is disfavored & will occur only under the standards and mechanics of Rule 16 and / or Rule 6, as applicable.
