Filing 106 ORDER: IT IS HEREBY ORDERED that Defendant Roddy Devall's 65 Reurged Motion to Dismiss is GRANTED IN PART AND DENIED IN PART. The motion is GRANTED to the extent it seeks dismissal of Payne's Section 1983 claim and her conspiracy claim. T he motion is DENIED WITHOUT PREJUDICE to the extent it seeks dismissal of Payne's FMLA claim and Louisiana Revised Statute 33:2214(B)(1) claim. IT IS FURTHER ORDERED that Payne is granted leave to amend her complaint by April 19, 2017. If Payne is unable to cure the deficiencies in the complaint by that time, upon motion by a party, the Court will dismiss Payne's claims pursuant to the FMLA and Louisiana Revised Statute 33:2214(B)(1) against Devall.
