January 22, 2015 Opinion or Order Filing 25 ORDER granting 14 Motion to Dismiss for Failure to State a Claim. The allegations of racial discrimination and retaliation are DISMISSED WITHOUT PREJUDICE. As to these allegations, Plaintiff is given 30 days within which to amend his complaint to c ure these deficiencies. In the event that Plaintiff fails to file an amendment to his complaint within that time, his claims of racial discrimination and retaliation will be dismissed with prejudice.
