The state-law claims against MDOC are DISMISSED WITHOUT PREJUDICE. Defendants Lee County Circuit Court and Monroe County Circuit Court are DISMISSED WITH PREJUDICE, and that Oxford County Jail is DISMISSED WITH PREJUDICE until pro se Plaintiff James Curry, Jr., successf ully has the state-court convictions and sentences invalidated, via appeal, post conviction relief, habeas, or otherwise. The § 2254 habeas claims are DISMISSED WITHOUT PREJUDICE for failure to exhaust state remedies. The remainder of the case shall proceed. Signed by District Judge Daniel P. Filing 14 ORDER DISMISSING MDOC, STATE COURTS, AND OXFORD COUNTY JAIL: For the reasons stated in the order, the § 1983 claims against Defendant Mississippi Department of Corrections should be and are hereby DISMISSED WITH PREJUDICE. The state-law claims against MDOC are DISMISSED WITHOUT PREJUDICE. Defendants Lee County Circuit Court and Monroe County Circuit Court are DISMISSED WITH PREJUDICE, and that Oxford County Jail is DISMISSED WITH PREJUDICE until pro se Plaintiff James Curry, Jr., successf ully has the state-court convictions and sentences invalidated, via appeal, post conviction relief, habeas, or otherwise.
