Bartoe's motion forpartial summary judgment is granted as to the Defendants' affirmative defenseunder the primary duty doctrine. Bartoe' ;s motion for partial summary judgment is denied as to Defendants' affirmative defense of limitation of liability. IT IS FURTHER ORDERED that Defendants motion for partial summary judgment [#48] is GRANTED in part and DENIED in part. Defendants& #039; motion for partial summary judgment is granted as to Bartoe's claims that ice on the deck rendered it unseaworthy. Defendants' motion for partial summary judgment is denied as to Bartoe's Jones Act claims for negligence relating to ice formation on the deck. Defendants' motion for partial summary judgment is denied as to Bartoe's claims that insufficient deckhands rendered the vessel unseaworthy. Defendants' motion for partial summary judgment is denied as to Bartoe's Jones Act claims for negligence for failing to provide sufficient deckhands. Signed by Honorable Rodney W.
