IT IS FURTHER ORDERED that Defenda nts' Motion to Dismiss [Doc #17], Counts I, II and IV as to the Individual Defendants Harmon, Fortune and Walker, is GRANTED. IT IS FURTHER ORDERED that Defendants' Motion to Dismiss [Doc #17], as to Counts V and VI, is GRANTED. IT IS FURTHER ORDERED that the only remaining claims are Plaintiff's Count I claim against Trinity regarding whether he was demoted and suspended because of his race, and Count III.
