Filing 12 MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that the Clerk shall issue process or cause process to issue on the second amended complaint [Doc. #11] as to all of the named defendants in their individual capacities only with respect to the claims outli ned above. IT IS FURTHER ORDERED that, in their individual capacities only, defendants Huffman Phillips, Hoskins, McGill, Wilheight, Roach, Wansing and Arnold, shall file an answer or other responsive pleading directed to plaintiff's First Amend ment retaliation claims. Defendants shall so respond within the time provided by the applicable provisions of Rule 12(a) of the Federal Rules of Civil Procedure. IT IS FURTHER ORDERED that, as to defendants in their official capacities, the Clerk sha ll not issue process or cause process to issue upon the second amended complaint, because plaintiff's official capacity claims are legally frivolous and fail to state a claim upon which relief can be granted. IT IS FURTHER ORDERED that, as to plaintiff's access to courts claims, the Clerk shall not issue process or cause process to issue upon the second amended complaint, because the second amended complaint is legally frivolous and fails tostate a c laim upon which relief can be granted with respect to these claims. See 28 U.S.C. § 1915(e)(2)(B). IT IS FURTHER ORDERED that as to plaintiff's Fourteenth Amendment Due Process/Loss of Property claims, the Clerk shall not issue process or c ause process to issue upon the second amended complaint, because the second amended complaint is legally frivolous and fails to state a claim upon which relief can be granted with respect to these claims. See 28 U.S.C. § 1915(e)(2)(B). IT IS FUR THER ORDERED that as to plaintiff's conspiracy claims, the Clerk shall not issue process or cause process to issue upon the second amended complaint, because the second amended complaint is legally frivolous and fails to state a claim upon which relief can be granted with respect to these claims. See 28 U.S.C. § 1915(e)(2)(B). IT IS FURTHER ORDERED that, pursuant to the Court's differentiated case management system, this case is assigned to Track 5B (standard prisoner actions). IT IS H EREBY ORDERED that plaintiff's motion to amend his complaint [Doc. #3] is GRANTED. IT IS FURTHER ORDERED that plaintiff's motion to proceed in forma pauperis [Doc. #2] is GRANTED. IT IS FURTHER ORDERED that the plaintiff shall pay an initia l filing fee of $3.65 within thirty (30) days of the date of this Order. Plaintiff is instructed to make his remittance payable to "Clerk, United States District Court," and to include upon it: (1) his name; (2) his prison registration number; (3) the case number; and (4)that the remittance is for an original proceeding. IT IS FURTHER ORDERED that plaintiff shall submit a second amended complaint, in accordance with the instructions set forth above, no later than thirty (30) days of the date of this Memorandum and Order. IT IS FURTHER ORDERED that if plaintiff fails to pay the initial partial filing fee within thirty (30) days of the date of this Order or fails to file a second amended complaint in accordance with the instruc tions set forth in this Order, then this case will be dismissed without prejudice. IT IS FURTHER ORDERED that the Clerk of the Court shall mail to plaintiff five blank form complaints for the filing of a prisoner civil rights complaint, as well as fi ve blank form motions for leave to proceed in forma pauperis.
