MEMORANDUM AND ORDER re: 1 MOTION to Vacate, Set Aside or Correct Sentence (2255) filed by Petitioner James Richard Hendrix; Finally, because the officers were acting in accordance with established Eighth Circuit precedence at the time they plac ed the device, no legitimate purpose is served by the exclusionary rule and the evidence should not have been suppressed after the fact.
