IT IS FURTHER ORDERED that the Clerk shall issue process or causeprocess to issue upon the complaint as to the individual capacity claims against defendants Graham and Novak. Defendants shall be served through the waiver agreements the Court maintains with Correctional Medical Services.IT IS FURTHER ORDERED that, pursuant to 42 U.S.C. § 1997e(g)(2), defendants Graham and Novak shall reply to plaintiffs claims within the time provided by the applicable provisions of Rule 12(a) of the Federal Rules of CivilProcedure. IT IS FURTHER ORDERED that the Clerk shall not issue process or cause process to issue upon the complaint as to the official capacity claims against defendants Graham and Novak because, as to these claims, the complaint is legally frivolous or fails to state a claim upon which relief can be granted, or both. I T IS FURTHER ORDERED that plaintiff's motion for appointment of counsel [Doc. #6] is DENIED.
