IT IS FURTHER ORDERED that defendants Michael Hakala, Robin Fincher, and Corizon Medical Services, Inc., shall file an answer or other responsive pleading directed to plaintiffs amended complaint within the time provided by the applica ble provisions of Rule 12(a) ofthe Federal Rules of Civil Procedure. IT IS FURTHER ORDERED that, as to defendants George A. Lombardi, Bill Stange, Glenn Babitch, Cleveland Rayford, and Missouri Delta Medical Center, the Clerk shall not issue process or cause process to issue, because the amended complaint is legally frivolous and fails to state a claim upon which relief can be granted. Plaintiff will be excused from paying the $9.76 initial partial filing fee on or before October 6, 2012, as previously ordered by this Court; however plaintiff will not be excused from ultimately paying the entire $350 filing fee. IT IS FURTHER ORDERED that the Clerk of Court shall direct the agency having custody of plaintiff to begin forwarding payments from plaintiff's inmate account pursuant to 28 U.S.C. § 1915(b)(2), until the full amount of the entire $350filing fee is paid. Plaintiff is instructed to make his remittance payable to "Clerk, United States District Court," and to include upon it: (1) his name; (2) his prison registration number; (3) the case number; and (4)that the remi ttance is for an original proceeding. IT IS FURTHER ORDERED that if plaintiff fails to pay the initial partial filing fee within thirty (30) days, without first showing good cause, the Court will dismiss this action without prejudice and without furt her notice to plaintiff.IT IS FURTHERORDERED that plaintiff shall file an amended complaint on or before September 4, 2012, that complies with this Memorandum and Order. IT IS FURTHER ORDERED that, in addition to a copy of this Order, the Clerk shall mail plaintiff a copy of the Court's form for prisoners to file a "Complaint Under the Civil Rights Act, 42 U.S.C. § 1983." IT IS FURTHER ORDERED that if plaintiff fails to comply with this Order, the Court will dismiss this acti on without prejudice and without further notice to plaintiff. If the case is dismissed for non-compliance with this Order, the dismissal will not constitute a "strike" under 28 U.S.C. § 1915(g).
