June 17, 2014 Filing 60 MEMORANDUM OPINION: Based on the foregoing, the Court finds that plaintiff has not established by a preponderance of the evidence that Dr. Burns breached the standard of care by failing to diagnose his infection, sending him home from the hospital without antibiotics, and failing to check the results of the culture. Therefore, the defendants are entitled to judgment on plaintiff's claims of medical negligence. A judgment consistent with this Memorandum Opinion will be entered separately.
