MEMORANDUM AND ORDER..IT IS HEREBY ORDERED that the Clerk shall issue process or cause process to be issued on the amended complaint as to defendants Brandon Lowe and Wade Dare, in their individual capacities. IT IS FURTHER ORDERED that defendants Br andon Lowe and Wade Dare, in their individual capacities, shall file a responsive pleading directed to plaintiff's Fourth and Fourteenth Amendment claims, as set forth in the amended complaint, pursuant to Rule 12 of the Federal Rules of Civil P rocedure. IT IS FURTHER ORDERED that plaintiff's Eighth Amendment claims against defendants Brandon Lowe and Wade Dare, as set forth in the amended complaint [Doc. #9], are DISMISSED, without prejudice, pursuant to 28 U.S.C. § 1915(e)(2)(B). IT IS FURTHER ORDERED that, pursuant to the Court's differentiated case management system, this case is assigned to Track 5B (standard prisoner actions). Signed by District Judge Stephen N. IT IS FURTHER ORDERED that plaintiff shall pay an initial partial filing fee of $42.51 within thirty (30) days f rom the date of this Order. Plaintiff is instructed to make his remittance payable to "Clerk, United States District Court". IT IS FURTHER ORDERED that the Clerk shall not issue process or cause process to issue upon the complaint at this t ime. IT IS FURTHER ORDERED that plaintiff shall file an amended complaint within thirty (30) days from the date of this Order.
