Filing 9 MEMORANDUM AND ORDER re: 3 MOTION for Leave to Proceed in forma pauperis under 42:1983 (prisoner) filed by Plaintiff Brian Gardner, motion is GRANTED. IT IS FURTHER ORDERED that plaintiff shall pay an initial filing fee of $12.40 within th irty (30) days of the date of this Order. Plaintiff is instructed to make his remittance payable to "Clerk, United States District Court," and to include upon it: (1) his name; (2) his prison registration number; (3) the case number; and (4 ) that the remittance is for an original proceeding. IT IS FURTHER ORDERED that plaintiff's supplement to the complaint [Doc. #8] is STRICKEN from the record. IT IS FURTHER ORDERED that the Clerk shall not issue process or cause process to issue upon, because the amended complaint is legally frivolous and fails to state a claim upon which relief can be granted. Petitioner shall complete this f orm in its entirety and return it to the Court within thirty (30) days from the date of this Order. IT IS FURTHER ORDERED that the Clerk shall forward to petitioner the court-provided form for filing a motion to proceed in forma pauperis in habeas co rpus cases. Petitioner shall either pay the $5 filing fee or complete this form in its entirety and return it to the Court within thirty (30) days from the date of this Order. IT IS FURTHER ORDERED that if petitioner fails to comply with this Order, the Court will dismiss this action, without prejudice and without further notice to him. Response to Court due by 7/21/2014.
