Therefore Seratt is not entitled to an evidentiary hearing on his Section 2255 motion. Accordingly, this Court denies Seratt's petition for relief pursuant to Title 28, United States Code, Section 2255 based upon the record before it. IT IS FURTHER ORDERED this Court will not issue a certificate of appealability because Seratt has not made a substantial showing of the denial of a federal constitutional right. Filing 10 MEMORANDUM AND ORDER: The petitioner's claims as expressed above are inadequate of their face and the record affirmatively refutes the factual assertions upon which they are based. Therefore Seratt is not entitled to an evidentiary hearing on his Section 2255 motion.
