MEMORANDUM AND ORDER re: #4 MOTION to Appoint Counsel filed by Plaintiff Denver Blackwell, #2 MOTION for Leave to Proceed in forma pauperis under 42:1983 (prisoner) filed by Plaintiff Denver Blackwell: IT IS HEREBY ORDERED that plaintiff's motion seeking leave to commence this action without prepaying fees or costs (ECF No. 2) is GRANTED. IT IS FURTHER ORDERED that, within thirty (30) days of the date of this order, plaintiff must pay an initial filing fee of $74.75. Plaintiff is instructed to make his remittance payable to Clerk, United States District Court, and to include upon it: (1) his name; (2) his prison registration number; (3) the case number; and (4) the statement that the remittance is for an original proceeding. IT IS FURTHER ORDERED that plaintiff's Motion to Appoint Counsel (ECF No. 4) is DENIED without prejudice. IT IS FURTHER ORDERED that Dr. Oscar Goodhand is DISMISSED from this action, without prejudice. A separate order of partial dismissal will be entered herewith.
