MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that the Clerk of Court shall prepare an alias summons for defendant Jane Wilkinson, using the address listed in Corizon Health's in camera response [Doc. # 19 ], and shall docket said alias summons under seal. IT IS FURTHER ORDERED that the United States Marshals Service shall serve defendant Jane Wilkinson in her individual capacity in accordance with Rule 4 of the Federal Rules of Civil Procedure. IT IS FURTHER ORDERED that the Marshal 39;s return of summons for defendant Jane Wilkinson shall be filed under seal. MEMORANDUM AND ORDER re: 4 , 2 ORDERED that plaintiff's motion to proceed in forma pauperis [Doc. #2] is GRANTED. FURTHER ORDERED that plaintiff shall pay an initial filing fee of $1.87 within thirty (30) days of the date of this Order. FURTHER ORDERED that plaintiff's motion for appointment of counsel [Doc. #4] is DENIED without prejudice to refiling at a later time. FURTHER ORDERED that plaintiff's 42 U.S.C. 1981 claims are DISMISSED, without prejudice. FURTHER ORDERED that plaintiff's 42 U.S.C. 1983 Fourteenth Amendment claims are DISMISSED, without prejudice. FURTHER ORDERED that, as to plaintiff's 42 U.S.C. 1983 Eighth Amendment claims against Dr. Kednis Archer, Roschell Davis, and Jane Wilkinson, em ployees of Corizon, Inc., working at the Northeast Correctional Center, the Clerk shall issue process or cause process to issue on the complaint as to each said defendant in their individual capacities. FURTHER ORDERED that plaintiff's 42 U.S.C. 1983 Eighth Amendment claims against Dr. Kednis Archer, Roschell Davis, and Jane Wilkinson, employees of Corizon, Inc., in their official capacities are DENIED as moot. FURTHER ORDERED that, pursuant to 42 U.S.C. 1997e(g)(2), defendants shall reply to the complaint within the time provided by the applicable provisions of Rule 12(a) of the Federal Rules of Civil Procedure. FURTHER ORDERED that, pursuant to the Court's differentiated case management system, this case is assigned to Track 5B (standard prisoner actions).
