Filing 32 OPINION, MEMORANDUM AND ORDER - IT IS HEREBY ORDERED that Defendants City of La Grange, Dale McNelly, Jeff Curl, and Josh Daviss Motion to Dismiss Plaintiffs Petition [ECF No. 16 ] is GRANTED. IT IS FURTHER ORDERED that Plaintiff Jerry Brandts c laims of violations of Fourth and Fourteenth Amendments, and Plaintiffs negligence claim against Defendants City of La Grange, Dale McNelly, Jeff Curl, and Josh Davis shall be DISMISSED, without prejudice. IT IS FURTHER ORDERED that Plaintiff Jerry Brandts remaining claims against Defendants City of La Grange, Dale McNelly, Jeff Curl, and Josh Davis shall be DISMISSED, with prejudice. IT IS FURTHER ORDERED that Defendant Julie K. Flanagans Motion to Dismiss [ECF No. 18 ] is GRANTED. IT IS FUR THER ORDERED that Plaintiff Jerry Brandts claim against Defendant Julie K. Flanagan shall be DISMISSED, without prejudice. IT IS FURTHER ORDERED that Defendant Progressive Casualty Insurance Companys Motion to Dismiss [ECF No. 8 ] is GRANTED. 13 The exception to this rule is the right of a third party to sue an insurance company for negligent misrepresentation which is not at issue in this case. Grisamore, 306 S.W.3d at 574. IT IS FURTHER ORDERED that Plaintiff Jerry Brandts claim against Defendant Progressive Casualty Insurance Company shall be DISMISSED, with prejudice.
