ORDER OF PARTIAL DISMISSAL pursuant to 28 U.S.C.1915(e)(2)(B) - IT IS HEREBY ORDERED that plaintiffs claims against defendant Gateway Company brought pursuant to 42 U.S.C. 1983 are DISMISSED without prejudice. See 28 U.S.C. 1915(e)(2)(B). IT IS FURTHER ORDERED that an appeal of this Order of Partial Dismissal would not be taken in good faith. (Party Gateway Company terminated. without prejudice.) | Filing 7 MEMORANDUM AND ORDER - IT IS HEREBY ORDERED that plaintiffs motion seeking leave to commence this action without prepaying fees or costs [ECF No. #2 ] is GRANTED. IT IS FURTHER ORDERED that, within thirty (30) days of the date of this Order, plaintiff must pay an initial filing fee of $9.70. Plaintiff is instructed to make his remittance payable to Clerk, United States District Court, and to include upon it: (1) his name; (2) his prison registration number; (3) this case number; and (4) the statement that the remittance is for an original proceeding. IT IS FURTHER ORDERED that the Clerk of Court shall issue process or cause process to issue upon the Complaint as to defendant Mary Vest in her individual capacity as to the First Amendment retaliation claim. Defendant shall be served by issuance of summons and service by the U.S. Marshals Service and personally served at the address identified by Plaintiff, which is: Gateway Foundation, 55 East Jackson Boulevard, Suite 1500, Chicago, Illinois 60604.
