January 22, 2010 Opinion or Order Filing 18 REPORT AND RECOMMENDATIONS : For the reasons set forth above, it is the recommendation of the undersigned that the decision of the Commissioner of Social Security be reversed and remanded under Sentence 4 of 42 U.S.C. § 405(g). Upon remand, the ALJ should ensure that the hypothetical question posed to the VE corresponds to the ultimate RFC determination. To that end, the ALJ may wish to hold a supplemental hearing. The ALJ should also treat Higgins as a person closely approaching advanced a ge. The parties are advised that they have until February 8, 2010, to file written objections to this Report and Recommendation.
