Short's motion to amend his Section 2255 motion to raise a claim of actual innocence [#10] is GRANTED. IT IS FURTHER ORDERED that movant's motion to vacate, set aside, or cor rect his sentence under 28 U.S.C. § 2255, and amended motion to vacate, set aside, or correct his sentence [#1 and #4] are DENIED. IT IS FURTHER ORDERED that the Court will not issue a certificate ofappealability, as movant has not made a subst antial showing of the denial of afederal constitutional right. IT IS FURTHER ORDERED that movant's motion to advance the case on the docket [#12] is DENIED as moot. A separate Judgment in accordance with this Memorandum and Order is entered this same date.
