IT IS FURTHER ORDERED that the Court will not issue a certificate ofappealability, as movant has not made a subst antial showing of the denial of afederal constitutional right. IT IS FURTHER ORDERED that movant's motion to advance the case on the docket [#12] is DENIED as moot. A separate Judgment in accordance with this Memorandum and Order is entered this same date.
