March 6, 2012 Opinion or Order Filing 21 MEMORANDUM AND ORDER IT IS HEREBY ORDERED that movant James Glenn Hayess Motion under 28 U.S.C. § 2255 to Vacate, Set Aside or Correct Sentence by a Person in Federal Custody is DENIED. IT IS FURTHER ORDERED that movant James Glenn Hayes has not made a substantial showing of the denial of a constitutional right such that reasonable jurists would find the Court's assessment of the constitutional claims debatable, or that reasonable jurists would find it debatable whether t he Court was correct in its procedural rulings, and therefore this Court will not issue a certificate of appealability on those claims. See Miller-El v. Cockrell, 537 U.S. 332, 338 (2003); Slack v. McDaniel, 529 U.S. 473, 484-85 (2000). An appropriate judgment will accompany this Memorandum and Order. Signed by Honorable Charles A.
