Filing 33 MEMORANDUM OPINION..For each of the reasons discussed above, reasonable jurors could differ as to the meaning of the 2002 Settlement Agreement and Mutual Release. Therefore, the Court finds the language of the Release to be ambiguous, especially as t o its scope. Since the Release is ambiguous, theCourt will not grant Defendants motion for summary judgment. Accordingly, Defendants motion for summary judgment will be denied. In light of the Courts findings, the Court finds no need to further address the additionalgrounds for denial raised by the Plaintiff regarding the alleged breaches of the Standstill Agreement.
