MEMORANDUM OPINION - IT IS HEREBY ORDERED that defendant E.N.'s motion to dismiss, or in the alternative, to abstain from judgment is denied. IT IS FURTHER ORDERED that plaintiff's requested declaratory judgment relief is granted in part , and denied in part. The CGL policy, Policy #HM9126562, does not provide coverage with respect to the claims and causes of action asserted by defendant E.N. against Bainsaeid and Valley Village in the underlying lawsuit. The CU policy, Policy #UM B9126562, does not provide coverage with respect to the claims and causes of action asserted by defendant E.N. against Bainsaeid in the underlying lawsuit, but does provide coverage with respect to the claims and causes of action against Valley V illage. Argonaut is not obligated to defend or indemnify Bainsaeid in connection with any claims in the underlying suit. Argonaut is obligated to defend and indemnify Valley Village in the underlying suit pursuant to the CU policy. A separate Judgment shall accompany this Memoradum Opinion. MEMORANDUM AND ORDER IT IS HEREBY ORDERED that the motion for summary judgment of plaintiff Argonaut Great Central Insurance Company [#60] is GRANTED in part, and DENIED in part. Both policies exclude coverage for all claims brought by E.N. against Nasser Bainsaeid. Neither policy covers any claims for punitive damages. The Commercial General Liability policy excludes coverage for all claims brought by E.N. against Comfort Inn. The Commercial Umbrella policy excludes claims brought by E.N. aga inst Comfort Inn relating to the October 8, 2008 incident. The motion for summary judgment is denied only as to the issue of whether the Commercial Umbrella policy excludes E. N.'s claims against Comfort Inn arising out of the December 2, 2008 incident. IT IS FURTHER ORDERED that the motion for summary judgment of defendant E.N. [#81] is denied. IT IS FURTHER ORDERED that the undersigned will hold a telephone conference with all counsel on Friday, March 22, 2013 at 9:30 a.m. to discuss a s chedule for resolving the remaining issues in this case. Plaintiff's counsel isresponsible for placing the call. In advance of the telephone conference, counsel must meet and confer and attempt to come to an agreed schedule for all steps needed to finally resolve this case. If for some reason Argonaut thinks that seeking default judgment against this defendant is not appropriate, Argonaut shall explain that reasoning. 2. Defendant Valley Village shall file an answer or motion directed to service, and if it now agrees that service is proper, shall file a response to the motion to transfer.
