March 22, 2011 Opinion or Order Filing 6 MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that plaintiffs motion to proceed in forma pauperis [Doc. #5] is GRANTED IN PART AND DENIED IN PART. Plaintiff will be allowed to proceed with his lawsuit after payment of the initial partial filing fee. IT IS FURTHER ORDERED that the plaintiff shall pay an initial filing fee of $1.42 within thirty (30) days of the date of this Order. Plaintiff is instructed to make his remittance payable to Clerk, United States District Court, and to include upon it: (1) his name; (2) his prison registration number; (3) the case number; and (4) that the remittance is for an original proceeding. IT IS FURTHER ORDERED that plaintiffs request to proceed without paying any portion of the filing fee [Doc. #5] is DENIED. IT IS FURTHER ORDERED that plaintiffs failure to timely pay the initial partial filing fee will result in the dismissal of this case. ( Response to Court due by 4/22/2011.)
