Filing 34 MEMORANDUM & ORDER: IT IS HEREBY ORDERED that defendants Bank of America, NA, Countrywide Bank FSB, BAC Home Loans Servicing, LP, Federal National Mortgage Association, and Mortgate Electronic Registration Systems, Inc.'s motion to dismi ss for failure to state a claim is GRANTED as to all federal claims in Count III, and remains pending as to Counts I and II for disposition in state court. [Doc. 18]. IT IS FURTHER ORDERED that this action is REMANDED to the Circuit Court of I ron County, Missouri. IT IS FURTHER ORDERED that defendant Kozeny & McCubbin, L.C.'s motion to dismiss Count II for failure to state a claim remains pending for disposition in the state court. [Doc. 3].
