With re spect to plaintiff's claims that he was denied his Eighth Amendment right to be free from cruel and unusual punishment, IT IS FURTHER ORDERED that defendants' Motion for Summary Judgment (Doc. #38) is GRANTED as to plaintiff's c laims against defendant Cindy Griffith. IT IS FURTHER ORDERED that defendants' Motion for Summary Judgment (Doc. #38) is GRANTED to the extent plaintiff seeks monetary relief against defendants in their official capacities. Filing 6 MEMORANDUM AND ORDER -.... IT IS HEREBY ORDERED that plaintiff's motion to proceed in forma pauperis (Docket No. 2) is GRANTED. IT IS FURTHER ORDERED that plaintiff shall pay an initial filing fee of $1.70 within thirty(30) da ys of the date of this Order.......IT IS FURTHER ORDERED that if plaintiff fails to pay the initial partial filing fee within thirty(30) days of the date of this Order, then this case will be dismissed without prejudice. IT IS FURTHER ORDE RED that the Clerk shall issue process or cause process to issue upon the complaint as to defendants. As identified in the complaint, defendant Lindquest is employed by Correctional Medical Services and defendants Dodson, Storz, Brawley, Maxie an d Griffith are employed by the Missouri Department of Corrections. IT IS FURTHER ORDERED that, pursuant to 42 USC § 1997e(g)(2), defendants shall reply to plaintiff's claims within the time provided by the applicable provisions of R ule 12(a) of the Federal Rules of Civil Procedure. IT IS FURTHER ORDERED that plaintiff shall provide the Court with defendant John Doe's proper name and address within sixty(60) days of the date of this Order. Plaintiff's failure to do so in a timely manner will result in a dismissal of defendant John Doe from this action, without prejudice. IT IS FURTHER ORDERED that this case is assigned to Track 5B;Prisoner Standard. granting 2 Motion for Leave to Proceed in forma pauperis under 42:1983 (prisoner) for William John Wills, III.
