MEMORANDUM AND ORDER. (see order for details) IT IS HEREBY ORDERED that the motion of EMC Corporation to dismiss or, alternatively, to sever and transfer to the Northern District of California is GRANTED insofar as a transfer is sought and is DENIED without prejudice insofar as dismissal or severance is sought. [Doc. 65 ] IT IS FURTHER ORDERED that the motion of Hewlett-Packard Company to dismiss or sever is DENIED without prejudice. IT IS FURTHER ORDERED that the motion of Quantum Corporation to transfer to the Northern District of California and the motion of NetApp, Inc., to transfer to the Northern Dis trict of California are each GRANTED. [Docs. 88 , 92 ] IT IS FURTHER ORDERED that motion of NetApp, Inc., to dismiss for improper joinder or, alternatively, to sever is DENIED without prejudice. [Doc. 91 ] IT IS FINALLY ORDERED that the motions of CA, Inc., are DENIED as moot. [Docs. 69 , 71 ] An appropriate Order of Transfer shall accompany this Memorandum and Order.
