March 13, 2013 Opinion or Order Filing 32 MEMORANDUM AND ORDER IT IS HEREBY ORDERED that Plaintiffs' Motion for Contempt is DENIED as moot. (Doc. No. 14.) IT IS FURTHER ORDERED that Plaintiff's motion for Default Judgment as to damages is GRANTED. (Doc. No. 28.) IT IS FURTHER ORDER ED that Defendant shall pay to Plaintiffs those delinquent contributions due to the Plaintiff Funds for the period of March 1, 2006,through December 31, 2007, in the total amount of $40,244.91; estimated delinquent contributions for the period o f January 1, 2008 through December 31, 2012, in the amount of $112,691.24; the interest on such delinquent contributions in the amount of $86,840.25; and liquidated damages in the amount of $15,293.62. IT IS FURTHER ORDERED that Defendant shall pay to Plaintiffs attorney's fees in the amount of $13,790.00, and costs of $660.54. May 16, 2012 Opinion or Order Filing 11 MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that Plaintiffs' Motion to Compel (Doc. No. 9) is GRANTED. IT IS FURTHER ORDERED that Plaintiffs' request for an award of their attorneys' fees and costs related to the preparat ion of this motion is GRANTED. IT IS FURTHER ORDERED that, not later than Thursday, June 6, 2012, Defendant shall make its books and records available for audit and inspection by an auditor of Plaintiffs' choice and at Defendant's c ost, as required by this Court's Order of January 28, 2012. Failure to fully comply with this Order may result in a finding of civil contempt and the imposition of sanctions including a fine and/or incarceration. IT IS FURTHER ORDERED t hat Plaintiffs shall effect service of this Order and a copy of the Court's Order of January 28, 2012, (Doc. No. 7) on Defendant by whatever means they believe to be most effective, and shall promptly file a certificate of such service. (Response to Court due by 6/6/2012.) Signed by Honorable Audrey G.
