IT IS FURTHER ORDERED that this Court's ruling on Defendant's Motion to Dismiss Plaintiff's Complaint for Failure to Prosecute [ECF No. 37 ] shall be held in abeyance pending Plaintiff's compliance with this Order and attendance at the December 13, 2012 deposition.
