Filing 48 MEMORANDUM AND ORDER. (see order for details) The Court finds that summary judgment shall be granted as to Count III, alleging that Defendant Bishop made false and defamatory statements. However, the Court finds that a genuine issue of material fa ct exists with regard to Count I, alleging violations of the Missouri Human Rights Act, and Count II, Plaintiff's wrongful termination claim under the FMLA, and therefore, summary judgment will be denied. Accordingly, Defendants' Motion for Summary Judgment [ECF No. 33 ] will be GRANTED as to Count III of Plaintiff's complaint, and DENIED as to Count I and II. Signed by District Judge E.
