November 27, 2012	Filing 36 MEMORANDUM AND ORDER re: 18 15 13 ORDERED that Defendant's Separate and Independent Motions to (1) Dismiss Plaintiff's Complaint Pursuant to FRCP 12(b)(6) and 12(b)(1) or, in the Alternative, (2) Compel Arbitration and Dismiss or Stay Litigation Pursuant to 9 U.S.C. §§ 3-4 are GRANTED in part, and the parties are ordered to participate in Defendant's currently pending arbitrationproceeding. Defendant's Motions are DENIED without prejudice in all other respects . FURTHER ORDERED that this case is STAYED pending the completion of thearbitration proceeding. The parties shall jointly submit a notice updating the Court on the status of this case no later than ten (10) days following the completion of arbitratio n. FURTHER ORDERED that the Clerk of Court shall close this case for administrative purposes pending completion of the arbitration.FURTHER ORDERED that Plaintiff's Motion for Preliminary Injunction (ECF No.13) is DENIED as moot. FURTHER ORDERE D that Defendant's request for hearing and/or oral argument is DENIED as moot. FURTHER ORDERED that Defendant's Request for Judicial Notice (ECF No. 18) is GRANTED. Case stayed.
