April 13, 2015 Opinion or Order Filing 91 MEMORANDUM AND ORDER - IT IS HEREBY ORDERED that defendant's motion to alter or amend the judgment [#88] is granted in part. The award of prejudgment interest is reduced by $3520.13. An amended judgment accompanies this order. IT IS FURT HER ORDERED that plaintiff's motion for bill of costs [#87] is granted in part. The Clerk of Court shall tax the following costs in favor of Jamison Electric, LLC and against Hankins Construction Co.: Fees of the Clerk $97 Fees for transcripts necessarily obtained $3,251.70 TOTAL TAXABLE COSTS $3,348.70. December 31, 2014 Opinion or Order Filing 80 FINDINGS OF FACT AND CONCLUSIONS OF LAW. (see document for details) After reviewing all the evidence, I have concluded that Hankins breached the subcontract by not paying Jamison the contract balance, plus two items of extra work, and that Jamison breached the subcontract by failing to complete certain items of work it was obligated to do. I have also concluded that Fidelity is not liable under the payment bond or for vexatious refusal to pay because Jamison instituted suit too early and was t herefore not in compliance with the terms of the bond. After totaling the parties' obligations, I have determined that Jamison's damages against Hankins, including prejudgment interest, amount to $84,593.06. I will enter judgment in J amison's favor in that amount. Hankins will bear all taxable costs of this action. I will enter judgment in Fidelity's favor on Jamison's claims of breach of the payment bond and vexatious refusal to pay. I will also require that Jamison indemnify Hankins and Fidelity for any claim made by Centrex. Judgment is entered separately. Signed by District Judge Catherine D. Perry on 12/31/2014. (CBL)
