April 3, 2013 Opinion or Order Filing 17 MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that Plaintiffs motion to dismiss without prejudice Doc. 14 is GRANTED. A separate order of dismissal is entered this same date. IT IS FURTHER ORDERED that, in the event Plaintiff re-files this same cause of action against P&G, whether in state or federal court, Plaintiff shall pay P&G the costs and reasonable attorneys fees it incurred in the instant cause of action, except for any expenses for work that can be used in the subsequent litigation. IT IS FURTHER ORDERED that, within ten (10) days of Plaintiffs re-filing this same cause of action against P&G, P&G shall file with this Court a statement of costs and reasonable attorneys fees for which it seeks reimbursement.
